Apr 11, 2019 Hero Arts

Hello friends,

You may have heard that Ellison, the parent company of Sizzix, has made claims of patent infringement against a number of companies in our industry, including Hero Arts.

Just so you know, there is absolutely no reason to change any purchasing patterns with Hero Arts, as Hero Arts does not infringe, believes the lawsuit is without merit, and intends to fight this lawsuit and win for the good of Hero Arts and the industry. Whether we like it or not, the legal process is a method to resolve disputes, and we must let that play out.

There is no reason to allow a chill on creativity or a disruption to business to creep into our beloved industry despite the current situation. In fact, let's work to do just the opposite and rally together to make our community even stronger. Hero Arts and the other companies involved remain the same creative, reliable, top selling brands you trust and love.

If you have any questions, do not hesitate to ask us at info@heroarts.com or leave a comment.

Yours in creativity,

There has been a lot of confusion in the crafting community around the ability to sell art work created with stamps. Angel policies seem to have emerged as the way to identify products that can be used. However they vary so much that it is utterly ridiculous to keep up with the latest. Why would a company like hero arts want sue a crafter for crafting with their stamp. Stamps were created to make multiple images otherwise we could just buy stickers. W ould a court even hear such a case. Has a stamp company ever sued a crafter selling stamped goods on eysy or a craft fair. Would you ever sue such a crafter? I only asked this question because yo said the crafting community should tick together yet crafters are throwing away their stamps sorting the ones they can use for personal use and the stamps they can use for items for sell.

I fully support you and believe the lawsuit is frivolous, a large company trying to throw their weight around. I was horrified to read that they have named individual bloggers in the suit as well. Their actions just expose the real heart of their company, where the bottom line is always more important than their own integrity.
Regardless of the outcome of the lawsuit, I will remember who brought it. I appreciate your reasonable response that shows your integrity; It explains how you have survived and thrived for 45 years. I hate that you have to expend time, energy and money to defend this, but the crafting community is on your side.

I’m with you Hero Arts. Sadly patents are not for creators and real inventors but for the first who “dares” to say technology or a product was ‘fully’ invented by them … sad!

Thank you, Hero Arts for a responsible explanation that doesn’t seek to force anyone to choose sides: “Whether we like it or not, the legal process is a method to resolve disputes, and we must let that play out.” This is so extraordinarily rare these days. You are demonstrating integrity and courtesy to those involved in the lawsuit and to your customers. I appreciate this. Thank you for your responsible stance. I don’t know the details and therefore the ins and outs of the law suit but I do know that sometimes law suits are used to bludgeon competition—and I hope that is not the case here.

I love all the companies targeted. Not pleased to hear this. I believe they have shot themselves in the foot as I now want to shy away from their products. This has been a community…us crafters never tire of supporting the entire industry. There is enough to go around.

So, sad to learn of this move by Ellison against Hero Arts and the other companies. I hope this sorry behavior backfires on them. I own maybe two sets of stamps from them and after this will never purchase another item. Hero Arts is a class act with awesome products and I totally support you and will continue to purchase as much as I can afford from you!

I noticed many designers have stopped using the Sizzix Big Shot or Big Shot Plus or Vagabond in their Youtube.com tutorials. Noticed Many of the designers are now using the Gemini, Platinum, Cricut or Cuttlebug or other brand besides Sizzix/Ellison Die Cutting Machines. Now I know “why”…Ellison/Sizzix ARE shaking in their boots! The Gemini, Platinum, Cuttlebug, Cricut are far easier to use and very portable to tote to classes and/or workshops plus they are “compact”!
Ellison/Sizzix have been losing a LOT of customers within past two to three years if not more which means lose in revenue which “may” be reason for recent lawsuits. I “see” Ellison/Sizzix losing this legal battle agains Hero Arts, Avery Elle, Heartfelt Creations, Stephanie Barnard, etc. Like the Spelbinders vs QuikCuts outcome where Spellbinders took a legal big hit…Ellison/Sizzix will face the same outcome and lose big time in court and industry! Many of us ARE LOYAL Customers to Hero Arts, lawn Fawn, Heartfelt Creations, MFT, PPP, Altenew, Avery Elle, etc vs Ellison/Sizzix. I feel for Tim Hotlz who got double whammy with MISTI and now Ellison/Sizzix.
HANG IN THERE HERO ARTS! HERO ARTS WILL PREVAIL AND SO WILL THE OTHER DEFENDANTS IN THIS “UNMERITED” LAWSUIT! My Question IS “WHY” Now IS Ellison/Sizzix filing these lawsuits?!

First MISTI now Ellison/Sizzix?! Why NOW with Ellison/Sizzix have so many years?! Both companies have one thing in common…Tim Holtz…so how will this impact Tim Holtz and his products? Boy I “see” the “greedy” green eyed monster lurking behinds these lawsuits…
Will google and read up on these “crazy” lawsuits by MISTI and Ellison/Sizzix. I have past issues with Ellison/Sizzix regarding their products and customer service…they make promises to customer and NEVER keep them! Still waiting for them to send promesed replacement handle for my Teal Limited Edition Big Shot and Cutting Plates for Big Shot which was promised over year ago!
Instead of this lawsuit….Ellison/Sizzix NEEDS to DO and internal AUDIT on their Customer Service and Staff who handle the inventory, sales and anything dealing with funds and product inventory. Funds and Inventory in large companies CAN “easily” go “unnoticed”…Trust me…I have “witnessed” many products “disappear” from inventory and books being “cooked”!

Plan to boycott the Ellison line until this matter is resolved. The stamping community has been so supportive of one another historically, there is room for more than one business to succeed!

I will not be buying a single Sizzix Ellison item from this day forward u less they drop this lawsuit. I see this as an attempt to shut down many good small companies. This is the nastiest way to do business.

I would love to see all the you tubers who support these fine companies involved in this lawsuit not use any Sizzix or Ellison products in their you tube videos from this day forward. We must use our money to support these companies and use our money to show Sizzix this is not how to do business in this community.

Do these companies have to stop selling dies during the legal battle in court? Or would they only after the legal battle is finished?

Too bad people didn’t stand up to the Misti patent that is also without merit and has a “chilling effect” on creativity.

What’s with the patent office issuing patents to technology that’s not novel?

And what’s next? Will companies be patenting scissors, guillotine trimmers, score boards? For pete’s sake!
